Distance Sales Contract

Distance Sale Agreement

1. PARTIES

This Agreement is signed between the following parties under the following terms and conditions.

By accepting this agreement, the BUYER acknowledges that if they confirm the order subject to this agreement, they will be obligated to pay the order amount and any additional fees such as shipping and taxes, and they accept this in advance.

 

2. DEFINITIONS

In the implementation and interpretation of this agreement, the terms written below will express the explanations written next to them.

  • MINISTER: Minister of Customs and Trade,
  • MINISTRY: Ministry of Customs and Trade,
  • LAW: Law No. 6502 on Consumer Protection,
  • REGULATION: Distance Contracts Regulation,
  • SERVICE: Any consumer transaction other than the supply of goods that is performed or undertaken to be performed in return for a fee or benefit,
  • SELLER: The company that offers goods to the consumer within the scope of commercial or professional activities or acts on behalf of or on account of the goods supplier,
  • BUYER: The real or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes,
  • SITE: The internet site belonging to the SELLER,
  • ORDERER: The real or legal person who requests a good or service through the internet site belonging to the SELLER,
  • PARTIES: The SELLER and the BUYER,
  • AGREEMENT: This agreement concluded between the SELLER and the BUYER,
  • GOODS: The movable property subject to shopping and intangible goods such as software, sound, image, and similar prepared for use in electronic environment,

 

3. SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts regarding the sale and delivery of the product whose characteristics and sales price are specified below, ordered by the BUYER through the internet site belonging to the SELLER in electronic environment.

The listed and announced prices on the site are the sales prices. The announced prices and promises are valid until they are updated and changed. Prices announced for a limited time are valid until the end of the specified period.

7. INFORMATION ABOUT THE PRODUCT(S) SUBJECT TO THE AGREEMENT

1. The basic characteristics of the goods/product(s)/service (type, quantity, brand/model, color, number) are published on the internet site belonging to the SELLER. If a campaign has been organized by the Seller, you can examine the basic characteristics of the relevant product during the campaign period. Valid until the campaign date.

 

7.2. Prices

The listed and announced prices on the site are the sales prices. The announced prices and promises are valid until they are updated and changed. Prices announced for a limited time are valid until the end of the specified period.

 

7.3. Taxes and Payments

The sales price of the goods or services subject to the agreement, including all taxes, is shown by being published on the site.

9. GENERAL PROVISIONS

9.1. Information and Acceptance

The BUYER accepts, declares, and undertakes that they have read the preliminary information about the basic characteristics of the product subject to the agreement, sales price, payment method, and delivery on the internet site belonging to the SELLER, that they are informed, and that they have given the necessary confirmation in electronic environment.

 

9.2. Delivery Time

Each product subject to the agreement is considered to be delivered together with the installation after the sales transaction.

 

10. RIGHT OF WITHDRAWAL

The BUYER may exercise their right of withdrawal from the agreement by rejecting the goods without giving any reason, provided that they notify the SELLER within 14 days from the delivery date of the product to themselves or to the person/institution at the address they have shown, in case the distance contract is related to the sale of goods.

 

12. DEFAULT AND LEGAL CONSEQUENCES

The BUYER accepts, declares, and undertakes that in case they make payment transactions with a credit card and default, they will pay interest within the framework of the credit card agreement between them and the card-issuing bank and will be responsible to the bank.

 

13. COMPETENT COURT

In the resolution of disputes that may arise from this Agreement between the parties, amicable settlement methods will be sought first. In case amicable settlement is not possible, the laws of the Republic of Turkey will be applied in the resolution of the dispute, and Istanbul (Çağlayan) Courts and Enforcement Offices will be authorized.

 

 

14. EFFECTIVENESS

The BUYER is deemed to have accepted all terms of this agreement when they make the payment for the order they have placed through the Site.
